Section 01

Acceptance of these Terms

By accessing or using ConsultDoc (including our website, mobile application, clinic dashboard, or voice/phone-based services), you agree to these Terms & Conditions. If you do not agree, do not use the service.

Section 02

What ConsultDoc is (and is not)

ConsultDoc provides an administrative platform to help users share information and request or arrange appointments with independent healthcare providers (such as clinics and doctors), including via web and mobile channels.

ConsultDoc does not provide medical care. We do not diagnose conditions, provide clinical triage, prescribe, or recommend treatment. All medical advice and care decisions are made by the healthcare provider you engage with.

Section 03

Not for Emergencies

ConsultDoc is not an emergency service. If you believe you are experiencing a medical emergency or urgent symptoms, call emergency services (000 in Australia) or attend your nearest emergency department immediately. Do not rely on ConsultDoc for emergency response.

Section 04

Eligibility and Use of the Service

You must use ConsultDoc lawfully and responsibly. You agree that you will:

  • Provide information that is accurate and not misleading (including contact details and information about symptoms).
  • Not impersonate another person.
  • Not misuse the service (including attempts to disrupt, exploit, or access systems without authorisation).
  • Not use ConsultDoc for unlawful or abusive behaviour.

If you are using ConsultDoc on behalf of someone else (for example, a family member), you confirm you have authority to share their details and make requests on their behalf.

Section 05

Account, Verification, and Communications

ConsultDoc may use verification methods such as SMS, phone verification, or in-app verification to confirm your identity or contact details. You agree we may contact you using the information you provide for service-related reasons such as verification, appointment coordination, and service updates.

Section 06

Appointments and Booking Process

ConsultDoc helps facilitate appointment requests and transfers relevant information to a healthcare provider for the purpose of booking. Appointment availability and confirmation are controlled by the healthcare provider. An appointment is not confirmed until the healthcare provider confirms it.

We do not guarantee that:

  • A provider will accept your booking request.
  • An appointment time will be available.
  • A provider will provide services.
Section 07

Cancellations, Rescheduling, and No-Show Policies

Cancellation and rescheduling rules may be set by the healthcare provider. Providers may charge fees for late cancellations or no-shows under their own policies. You are responsible for understanding and complying with provider policies.

Section 08

Fees and Payments

ConsultDoc may be free to use or may introduce fees in the future. If ConsultDoc charges any fees, we will clearly disclose them before you incur charges. Healthcare providers may charge consultation fees or other service fees. Those fees are between you and the provider, not ConsultDoc, unless explicitly stated otherwise. Medicare eligibility is determined by the provider, and ConsultDoc is not responsible for provider billing outcomes.

Section 09

Voice Interactions, Recording, and Transcription

ConsultDoc may offer voice-based interactions (including voice AI) to capture information and help facilitate booking. Depending on configuration, voice interactions may be recorded and/or transcribed to capture booking details and improve accuracy of appointment requests.

By using the service, you acknowledge that AI may not always interpret information accurately and you are responsible for ensuring the information you provide is correct.

Section 10

Privacy and Data Handling

Our collection, use, storage, and disclosure of personal information (including health information) is described in our Privacy Policy. By using ConsultDoc, you understand that we may share relevant information with the healthcare provider(s) involved to facilitate appointment booking and follow-up.

Section 11

Third-Party Services

ConsultDoc may use third-party services to deliver parts of the platform (such as communications infrastructure, hosting, analytics, and security tooling). ConsultDoc is not responsible for third-party outages or failures that are outside our reasonable control.

Section 12

User Content and Permissions

You retain ownership of the information you provide to ConsultDoc. You grant ConsultDoc a licence to use, store, reproduce, and share this information only as required to operate the service, including facilitating booking and communicating with providers.

Section 13

Intellectual Property

ConsultDoc (and its licensors) owns all intellectual property rights in the platform, including software, branding, designs, and content (excluding your information). You must not copy, modify, reverse engineer, or distribute any part of ConsultDoc unless permitted by law or by us in writing.

Section 14

Service Availability and Changes

ConsultDoc may change, suspend, or discontinue parts of the service, or introduce new features, from time to time. We may update these Terms from time to time. Continued use after updates means you accept the updated Terms.

Section 15

Suspension and Termination

We may suspend or restrict access if we reasonably believe you have breached these Terms, misused the service, or if required for security, legal, or operational reasons. You may stop using ConsultDoc at any time.

Section 16

Disclaimers

To the extent permitted by law, ConsultDoc is provided "as is" and "as available." We do not warrant that the service will always be available, error-free, or suitable for your specific needs. ConsultDoc is not responsible for healthcare services delivered by providers. Nothing in these Terms excludes rights you may have under the Australian Consumer Law that cannot be excluded.

Section 17

Limitation of Liability

To the extent permitted by law, ConsultDoc will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Where liability cannot be excluded, our liability is limited (at our option) to resupplying the service or paying the cost of having the service resupplied.

Section 18

Indemnity

You agree to indemnify ConsultDoc for losses arising from your misuse of the service, unlawful acts, or breach of these Terms (to the extent permitted by law).

Section 19

Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.

Section 20

Acknowledgement

By using ConsultDoc, you confirm that ConsultDoc is an administrative booking facilitation platform only, healthcare providers are fully responsible for medical care and decisions, and ConsultDoc is not liable for clinical outcomes or provider conduct.
